By accepting these Terms, or by using our Site, you agree to be legally bound by these Terms, our Privacy Policy, and any other underlying agreements or terms. When using this Site, including our contact and RFP submission forms, you agree that you will not: submit any information that is false, misleading, or that you do not have the right to share; upload or transmit any file, attachment, or content that contains a virus, malware, or other harmful code; impersonate any person or entity or misrepresent your affiliation with a person or entity; use any automated means (such as bots or scrapers) to access or interact with the Site or its forms; or attempt to interfere with, disable, or circumvent any security feature of the Site, including spam- or fraud-prevention measures such as reCAPTCHA.

User Submissions

Certain areas of our Site, including our Contact Us and Submit an RFP pages, allow you to submit information and files to us, such as your contact details, inquiry messages, community details, and supporting documents or attachments (“Submissions”). By making a Submission, you represent that you have the right to share the information and files you submit, and that they do not infringe the rights of any third party. You retain ownership of any files you submit, but you grant Barkan Companies a limited right to use, store, and review your Submissions solely for the purpose of responding to your inquiry, evaluating an RFP, or otherwise providing the services you requested. We handle personal information collected through these forms in accordance with our Privacy Policy. We reserve the right, but are not obligated, to review, monitor, or remove any Submission at our discretion.

We take all reasonable steps so that our Site is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and other technical issues. Therefore, we will not be liable if this Site is unavailable at any time.
