This privacy notice for Barkan Management Company, Inc., Barkan Compliance Solutions LLC, Barkan Real Estate Services, Barkan Companies LLC, and all affiliated entities (“we,” “us,” or “our”) describes how and why we might collect, store, use, and/or share (“process”) your information when you use our website at barkanco.com, communicate with us by SMS (text) messaging, or submit information through any of our online forms.

- Contact form submissions: name, email address, phone number, city, state, and ZIP code, your message, how you heard about us, and (optionally) basic details about your community
- RFP (Request for Proposal) submissions: name, email address, phone number, any additional details you share with us, and any documents you upload (which may include governing documents, financial records, or other community information)
- SMS opt-in: phone number, name, and email address (if provided)
- Message content: content of SMS messages sent and received
b. Information Collected Automatically:
- Browser type and version
- Pages visited and time spent on site
- Referring website or source
- Device type and operating system
- IP address and general geographic location
- Cookie and tracking data (see Section 6)
Our online forms are protected by Google reCAPTCHA, which collects technical and device information to help us detect and prevent spam and abuse. Use of reCAPTCHA is subject to Google’s Privacy Policy and Terms of Service.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Responding to Inquiries: Processing contact form submissions and RFP requests and connecting prospective clients with the appropriate Barkan team member
- We do not share your SMS consent or phone number with third parties for their own marketing purposes. We may share this information with service providers (such as our SMS delivery platform) solely to the extent necessary to send you messages
- Service Delivery: Managing ongoing client relationships and service requests
- Website Improvement: Understanding how visitors use our website and improving the user experience
- Marketing our services, as they may change from time to time
- Protecting against fraud, spam, and misuse of our forms
- Legal Compliance: Complying with applicable laws, regulations, and legal processes

11. Connecticut Residents
Under the Connecticut Data Privacy Act (CTDPA), Connecticut residents have the rights listed in Section 10 above. To submit a request, please email corporate@barkanco.com. If we decline your request and you wish to appeal, please contact us at the same address. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including a written explanation of our decision.
12. Virginia Residents
Under the Virginia Consumer Data Protection Act (VCDPA), Virginia residents have the rights listed in Section 10 above. To exercise your rights, email corporate@barkanco.com or submit a data subject access request. We will respond within forty-five (45) days of receipt. The response period may be extended once by an additional forty-five (45) days when reasonably necessary, with notice provided within the initial response period. Right to Appeal: If we decline your request, you may appeal by emailing corporate@barkanco.com. If your appeal is denied, you may contact the Virginia Attorney General to submit a complaint.
13. Massachusetts Residents
Barkan Management Company, Inc. complies with the Massachusetts Data Privacy Law (M.G.L. c. 93H) and applicable regulations. We maintain a comprehensive information security program designed to protect personal information from unauthorized access, use, or disclosure.
14. California Residents
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the rights listed in Section 10 above, including the right to opt out of the sale or sharing of personal information (which we do not engage in) and the right to limit use of sensitive personal information. Depending on your state of residence, you may have additional rights under other state privacy laws not specifically addressed above, including the right to be informed of the categories of personal data collected, the right to correct or delete your personal data, and the right to opt out of certain data processing activities. 16. Do Not Track
Some browsers offer a “Do Not Track” (DNT) signal. Because there is not yet an accepted standard for how businesses should respond to DNT signals, our website does not currently respond to DNT signals at this time.
We do honor the Global Privacy Control (GPC) signal, where legally required, as a valid request to opt out of the sale or sharing of personal information, to the extent we engage in such activity.
